What this amendment would do

This amendment was submitted by Mr. Coons to the bill S. 5. The purpose of the bill is to require the Secretary of Homeland Security to take into custody certain aliens who have been charged in the United States with theft.

To change the bill, the amendment removes the word 'and' on page 2, line 14, and strikes line 15 on page 2 to insert the following new text:

(ii) is not in a lawful status or in a period of stay authorized by the Attorney General; and
(iii) is charged with, is arrested for, is
