What this amendment would do
Mr. Coons submitted an amendment to the bill S. 5, which is a bill that requires the Secretary of Homeland Security to take into custody aliens who have been charged in the United States with theft.
The purpose of this amendment is to add an effective date section to the end of the bill. It aims to delay when section 2 of the bill and its amendments take effect.
Specifically, it prevents section 2 from taking effect until 60 days after the Secretary of Homeland Security publishes a certification to Congress in the Federal Register. This certification must include the basis of the findings and state that there is enough operational detention capacity, transportation capacity, and personnel available. These resources must be sufficient to ensure the section can be carried out without causing the release of, or an inability to detain or remove, aliens who present serious threats to public safety or serious flight risks.
