What this amendment would do

  • Mr. Coons, along with Mrs. Shaheen, submitted this amendment to the bill S. 5.

  • The bill itself requires the Secretary of Homeland Security to take into custody certain aliens who have been charged in the United States with theft.

  • The amendment adds a new section at the end of the bill, specifically SEC. 4. RULE OF CONSTRUCTION.

  • The purpose of this addition is to ensure that nothing in the Act may be construed to limit the ability of the Secretary of Homeland Security or the Attorney General to use available capacity to detain individuals determined to pose the most serious threat to public safety or risk of flight.
