What this amendment would do

The amendment proposes the Reforming Emergency Powers to Uphold the Balances and Limitations Inherent in the Constitution Act or the REPUBLIC Act. Its purpose is to change how national emergencies and emergency powers are handled by the President and reviewed by Congress, bringing accountability to our elected officials and keeping a check on executive power for the good of the people.

The amendment aims to change the law by setting a 30-day limit on national emergency declarations unless Congress passes a joint resolution of approval. It adds requirements for the President to specify which legal provisions are being used, report regularly to Congress and the public on expenditures and actions, and secure congressional renewal yearly. Furthermore, it adds strict protections, due process rights, and judicial review for United States persons targeted under the International Emergency Economic Powers Act, excludes the authority to impose certain duties and quotas under that Act, updates presidential war powers under the Communications Act of 1934 to require a declared national emergency, and forces the disclosure and sharing of presidential emergency action documents with specific congressional committees.
