What this amendment would do
Mrs. Murray submitted an amendment to the bill S. 5, which originally requires the Secretary of Homeland Security to take into custody certain aliens charged with theft in the United States.
The purpose of this amendment is to add protections for pregnant, nursing, and postpartum women to the bill. Specifically, it aims to change the bill by adding the following rules:
-
The Secretary of Homeland Security may not detain certain individuals who are pregnant, nursing, or in postpartum recovery unless the Secretary makes an individualized determination that the person presents a threat to public safety or national security.
-
The Secretary may not use a restraint on these detained individuals if they are known to be pregnant, including during labor, transport to a medical facility or birthing center, delivery, or postpartum recovery.
