What this amendment would do
This amendment allows certain non-citizens to enlist in the United States Armed Forces and changes how the naturalization process works for those who serve.
The amendment aims to add a new category of eligible individuals who can join the military. To qualify, these individuals must have lived continuously in the United States for five years, pass the required security vetting, and meet all standard enlistment rules. They must also fit into one of three specific groups: have deferred action under the Deferred Action for Childhood Arrivals policy, hold temporary protected status, or be the beneficiary of an approved immigrant visa petition who cannot adjust their status because a visa is not available or because they turned 21 years old before a visa became available.
Additionally, the amendment aims to change the law by granting an administrative stay of removal to these enlisted aliens if they serve honorably. It also provides rules for determining their good moral character when they apply for naturalization, protects the confidentiality of the information they provide by restricting its use for general immigration enforcement, and sets penalties for breaking those confidentiality rules.
