What this amendment would do

Mr. Murphy submitted an amendment to the bill S. 5. The original bill requires the Secretary of Homeland Security to take into custody certain aliens who have been charged with theft in the United States.

  • The amendment adds a new provision called Trust for law enforcement discretion.
  • It gives the Director for U.S. Immigration and Customs Enforcement the power to release a detained alien.
  • The Director can only do this if they determine the alien does not pose a danger to the community and is not a flight risk.
