What this amendment would do

Mr. Cruz submitted an amendment known as the Justice for Jocelyn Act. Its purpose is to enhance public safety through the detention, continuous monitoring, or removal of aliens unlawfully present in the United States.

Changes and Additions to the Bill

  • Limits on Alternatives to Detention: Stops the release of any alien through the Alternatives to Detention program unless every single detention bed available to the Secretary is filled, there is no other option to hold aliens in detention, and the Secretary has exhausted all reasonable efforts to hold them.

  • GPS and Curfew Rules: Requires every alien on the U.S. Immigration and Customs Enforcement nondetained docket to be enrolled in the Alternatives to Detention program, tracked with GPS continuously until their proceedings or removals are finished, and ordered to stay in their compliant home address from 10:00 p.m. to 5:00 a.m.

  • Mandatory Removal for Noncompliance: Adds a rule stating that if an immigration officer submits an affidavit showing an alien failed to follow a release condition, that alien will be ordered removed in absentia.
