What this amendment would do

This amendment replaces the entire text of the bill with provisions focused on the detention and adjustment of status of certain aliens, agricultural worker programs, and electronic employment verification.

  • It includes the Laken Riley Act, which requires the Secretary of Homeland Security to take into custody certain aliens charged with or convicted of burglary, theft, larceny, or shoplifting, and allows state attorneys general to bring civil actions regarding certain immigration enforcement decisions.

  • It provides pathways for certain long-term residents who entered the United States as children to obtain conditional permanent resident status and eventually lawful permanent residence.

  • It establishes temporary certified agricultural worker status for eligible individuals, as well as an optional path to lawful permanent residence for long-term agricultural workers.

  • It reforms the H-2A temporary worker program by creating a streamlined electronic platform, updating wage and housing requirements, and establishing a pilot program for portable H-2A visas.

  • It requires the mandatory use of an electronic employment eligibility verification system (E-Verify-style system) for the agricultural industry based on phased effective dates.
